DMCA Copyright Policy

How we handle copyright infringement claims under the Digital Millennium Copyright Act.

Crfted, Inc. (“Crfted,” “we,” “our,” or “us”), a Delaware public benefit corporation, respects the intellectual property rights of others and expects all users of the Crfted platform to do the same. This DMCA Copyright Policy explains how Crfted handles claims of copyright infringement in accordance with the Digital Millennium Copyright Act, 17 U.S.C. § 512 (“DMCA”).

Crfted qualifies as an Online Service Provider (“OSP”) under the DMCA. We have registered a Designated Agent with the U.S. Copyright Office (Registration No. DMCA-1071690) to receive notifications of claimed infringement as required by 17 U.S.C. § 512(c)(2).

IMPORTANT: This Policy applies exclusively to claims of copyright infringement. Trademark complaints should be directed to hello@crfted.co with the subject line “Trademark Complaint.”

2. Reporting Claimed Copyright Infringement — Takedown Notice

2.1 Required Elements of a Valid Takedown Notice

To be valid and actionable under 17 U.S.C. § 512(c)(3), your Takedown Notice must include ALL of the following:

  • A physical or electronic signature of the copyright owner or authorized agent;
  • Identification of the copyrighted work claimed to have been infringed;
  • Identification of the material that is claimed to be infringing and its location on the Platform (e.g., the URL);
  • Information sufficient to permit Crfted to contact you, including name, address, telephone number, and email address;
  • A statement of good faith belief that the use is not authorized by the copyright owner, its agent, or the law; and
  • A statement of accuracy and, under penalty of perjury, that you are the copyright owner or authorized to act on their behalf.

2.2 Where to Submit

Takedown Notices must be submitted by email to dmca@crfted.co or by mail to the address in Section 1. Email submission is strongly preferred.

2.3 Crfted’s Response to a Valid Takedown Notice

Upon receipt of a valid Takedown Notice, Crfted will:

  • Promptly remove or disable access to the identified material;
  • Notify the user who posted the content that the material has been removed and the reason;
  • Provide the user with a copy of the Takedown Notice; and
  • Inform the user of their right to submit a Counter-Notice.

3. Counter-Notice Procedure

If your content was removed and you believe the removal was the result of mistake or misidentification, you have the right to submit a Counter-Notice.

3.1 Required Elements of a Valid Counter-Notice

  • Your physical or electronic signature;
  • Identification of the material that was removed and its location before removal;
  • A statement under penalty of perjury that you have a good faith belief the material was removed by mistake or misidentification;
  • Your name, address, and telephone number; and
  • A statement consenting to the jurisdiction of the Federal District Court for your address.

3.2 Effect of a Valid Counter-Notice

Upon receipt of a valid Counter-Notice, Crfted will notify the original complainant and restore the removed material within ten (10) to fourteen (14) business days, unless Crfted receives notice of a filed court action.

4. Repeat Infringer Policy

Crfted maintains a policy of terminating, in appropriate circumstances, accounts of users who are determined to be repeat infringers. A “repeat infringer” is any user who has had content removed pursuant to two (2) or more valid DMCA Takedown Notices within any rolling twelve (12) month period.

5. Misrepresentation and Abuse of the DMCA Process

Section 512(f) of the DMCA imposes liability on any person who knowingly materially misrepresents that material is infringing (in a Takedown Notice) or that material was removed by mistake (in a Counter-Notice).

6. Handmade Content and IP on Crfted

Because Crfted is a handmade-only marketplace, the vast majority of content on the Platform is original work created by independent Makers. We take copyright infringement claims seriously precisely because we are committed to protecting the authentic creative work of our Maker community.
